JUSTICIA: Se investigará a Policía Federal por un hecho de torturas en 1998
La Corte Suprema de Justicia de la Nación aceptó que se investigue el caso de un hombre que denunció que en 1988 fue detenido y torturado por un efectivo de la Policía Federal.
En su acuerdo de hoy, el máximo tribunal hizo lugar de esta manera a una sentencia de la Corte Interamericana de Derechos Humanos, tribunal al que había recurrido la víctima luego de que la Justicia argentina considerara que el delito estaba prescripto.
Por mayoría, los jueces aceptaron un recurso de revocatoria del denunciante, Juan Francisco Bueno Alves, ya que en 2007 el alto tribunal había considerado que el delito había prescripto.
Ahora, se dejó sin efecto esa sentencia y se dispuso devolver las actuaciones para que se dé cumplimiento a lo dispuesto por la Corte Interamericana de Derechos Humanos en el caso “Bueno Alves vs. Argentina”.
Entonces, la causa volverá a su tribunal de origen, el juzgado de instrucción 13, donde se había imputado al policía René Derecho el delito de “apremios ilegales” contra Bueno.
Según la investigación, Bueno Alves habría sido trasladado a la División Defraudaciones y Estafas de la Policía Federal con el fin de que declarara contra su abogado, Carlos Pérez Galindo, y allí recibió golpes en la cabeza y en el estómago.
La Corte Interamericana consideró que los hechos denunciados por Alves constituían un caso de torturas y, por ende, una vulneración a derechos humanos, de manera que el Estado Argentino debía realizar las investigaciones para determinar las correspondientes responsabilidades.
El fallo fue votado en igual sentido por los jueces Enrique Petracchi, Juan Carlos Maqueda, Raúl Zaffaroni y Elena Highton de Nolasco, en tanto que Carlos Fayt y Carmen Argibay entendieron que debía rechazarse la presentación
