Caso contrario, las empresas tendrán un crédito a su favor, que luego el ENARGAS resolverá de qué manera se salda. Mientras tanto los usuarios tienen derecho a abonar las facturaciones sin ese cargo específico, y sin el IVA correspondiente señaló Polino.
El fundamento de la acción judicial es el siguiente: “el Poder Ejecutivo Nacional bajo el eufemismo de un cargo específico en realidad está estableciendo un impuesto, y como tal, debe ser sancionado por el Congreso Nacional a través de una ley específica”, concluyó Polino
